Terms and Conditions (tenancy feasibility, tenant suitability, and/or surveys)

By using the Mayordoma site (either as a service user using the site questionnaire.Mayordoma.com/admin or services.mayordoma.com/admin or as a person responding to a questionnaire from questionnaire.Mayordoma.com) you agree to the following terms and conditions.

Mayordoma reserves the right to modify these terms and if you use the site after the terms have been changed, you are accepting the new terms.


About the Service
The service refers to all functionality offered by the Mayordoma site, including but not limited to the ability to create, modify and submit questionnaires, as well as view their results. It also includes the ability to answer these questionnaires.


Mayordoma uses an infrastructure that allows the service to be kept running with minimal interruptions and errors, however, there may be situations in which the service is not available or is available intermittently. You agree to release Mayordoma from all liability in the event of any problems that may arise due to system failures or interruptions. Mayordoma may suspend, withdraw, interrupt or change the service without prior notice. We reserve the right to disable (some or all) the functionalities of the service for any account at any time, without prior notice.


Likewise, Mayordoma uses reasonable methods to safeguard the information registered by users, but you agree to release Mayordoma from any responsibility in the event of loss of information of any kind (such as information not available, deleted or altered without consent) and for any type of information (such as test or feasibility result information, tenant and/or landlord information, user questionnaires or surveys, among others)


You agree that you will use the results provided by Mayordoma at your own risk and that Mayordoma cannot guarantee the accuracy and validity of these, despite the efforts made to provide good service. Therefore, you release Mayordoma from any liability related to decisions you make based on information provided by Mayordoma (such as selecting a tenant based on the results of your Mayordoma global social tests or black list or bad tenant black list*).


Of the length of service
You can use the service as long as you have an active plan. An active plan is a plan that has a questionnaire balance greater than zero and that has not expired. You can continue to access the system even without an active plan to see previous results, however, Mayordoma reserves the right to terminate access to accounts that have been without an active plan for a long time (in which case prior notification will be sent).

None of the plans have refunds, so if you wish to cancel your subscription, any unused balance will be lost. In the event that the service is unilaterally canceled by Mayordoma, a proportional refund will be made for the unused active balance. To be credited to your registered bank account or GCash account on your name.

Either you or Mayordoma may unilaterally terminate your use of the Service at any time.


Advertising your use of Mayordoma
You allow us to advertise that your company or you use/s the Mayordoma service. We may use your name, logo and trademarks in our advertising or marketing materials and you grant us all necessary rights to do this. You may withdraw this permission at any time by sending an email to Tenancy@Mayordoma.com


Conditions for people undergoing area/unit feasibility or tenancy tests at Mayordoma

By answering an Mayordoma questionnaire you release Mayordoma from liability for any problem related to the service, including unavailability of the service, errors in results, loss of information, among others. You assign all rights to the content you enter as answers to the tests.

You will not copy Mayordoma questionnaire questions and you will not publish or share them (or their possible answers) in any media.

You agree that the answers you enter and the results of your test will be visible to the person or company that sent you the test, such as the registered landlord, as well as to Mayordoma. You authorize the person or company that sent you the test to use your answers and results within a process for evaluation purposes. You authorize Mayordoma to use your responses and results to perform an analysis with the aim of improving the tests and the platform in general.


Limitations

You will not copy, sublet or use the Service in any way that would allow you to offer a similar service based on it. You will not copy information from the service to other media with the intention of generating similar content to be used outside of Mayordoma.

Accounts and users should not be shared. An account should not be shared between multiple landlords' next of kin or not, companies and users should not be created for people from a company other than the one that contracted the account.

A user or company is entitled to only one free trial account. A user or company is not permitted to create multiple free trial accounts with the intention of having a greater number of free trials than a single free account provides. Mayordoma reserves the right to block or delete accounts that have been created with this intention.


Mayordoma is not responsible for any loss or damage, under any circumstances (including negligence or foreseeable), arising under or in connection with: the use or inability to use the Service. Please note that we will not be liable for: loss of profits, sales, business or revenue; business interruption; Loss of anticipated savings; Loss of business opportunity, goodwill or reputation; Or any indirect or consequential loss or damage. We do not guarantee that the site will be secure or free from errors or viruses and we will not be liable for any loss or damage caused by a virus or other harmful material. You will not use the service in a way that affects its operation or involves abuse of the use of the service.


Jurisdiction
Any dispute will be resolved under Philippine law and courts.


*Discrimination note: However, Tenant blacklists are not the answer. Privacy laws prohibit rental property owners and managers from creating or maintaining such lists. Without the proper measures in place, a list that singles out delinquent renters can lead to discrimination.
